Terms of Service

1. Acceptance of Terms

By accessing or using mewd.art ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

2. Age Requirement

You must be at least 18 years of age to access and use this Service. By using the Service, you represent and warrant that you are at least 18 years old and of the legal age of majority in your jurisdiction. The Service may include adult-oriented content generated by AI models, and access is restricted to adults only.

3. User Responsibility for Generated Content

You are solely and fully responsible for all images, videos, and any other content you generate using the Service ("Generated Content"). This includes responsibility for:

• The legality, appropriateness, and consequences of publishing or sharing your Generated Content;
• Ensuring you hold the necessary rights to any source images, videos, or prompts you upload to the Service;
• Obtaining consent from any identifiable individuals depicted in source materials you upload;
• Any damages, claims, or liabilities arising from your Generated Content.

We do not monitor, review, or assume any responsibility for user-generated content. You acknowledge that the Service is provided as a tool, and the manner in which you use it is entirely your own responsibility.

4. Prohibited Uses

You agree not to use the Service to:

• Generate content depicting real individuals without their explicit consent, including non-consensual intimate imagery;
• Generate content involving minors, or content that sexualizes minors in any form;
• Infringe upon the intellectual property rights, privacy rights, or publicity rights of any third party;
• Create content that is illegal, defamatory, harassing, or harmful in your jurisdiction;
• Attempt to reverse-engineer, scrape, or overload the Service or its underlying infrastructure.

5. Unsupported and Unlawful Content

The Service is an AI generation tool intended for lawful use. We do not provide, host, publish, or distribute content that is unlawful in the jurisdictions in which we operate, and we do not permit the Service to be used to create or share such content. No part of the Service is designed or offered for the purpose of producing, promoting, or distributing illegal material.

The Service does not support, and these Terms expressly prohibit, the generation of the following kinds of content:

• Graphic violence and gore: imagery or video depicting extreme violence, bloodshed, mutilation, torture, or cruelty;
• Minors: any content involving a person under 18 years of age, including any sexualized, abusive, or exploitative depiction of a minor, or any content that otherwise endangers or harms minors. Access to the Service is restricted to adults (see Section 2);
• Non-consensual intimate imagery, or content depicting real individuals without their consent;
• Content that is unlawful where you use the Service, or that promotes illegal activity, hatred, or violence against people or groups.

We do not offer these capabilities, and prompts, uploads, or generated output of this nature are not permitted on the Service. Content of this kind may be blocked, removed, or restricted, and accounts responsible for it may be suspended or terminated. See Section 4 for the full list of prohibited uses.

All content produced through the Service is generated at the direction of the user, from the prompts, images, or videos that user supplies. We do not pre-screen, endorse, verify, or claim ownership of user uploads or Generated Content, and we make no representation that any output is lawful in your jurisdiction or suitable for any particular purpose. Responsibility for the content you generate, and for how you use or share it, rests entirely with you (see Section 3).

We apply a zero-tolerance approach to illegal content. If we become aware of content that we reasonably believe violates these Terms or applicable law, we may remove or restrict it, suspend or terminate the accounts involved, and cooperate with law enforcement agencies or rights holders where required by law. Nothing in this section obliges us to monitor, review, or store all content submitted to or generated through the Service.

If you believe that content available through the Service is unlawful, infringes your rights, or otherwise violates these Terms, please report it to us. You may use the "Feedback & Complaints" entry in your account menu and select "Content Removal Request", or email us at support@mewd.art, including the relevant link or identifier, the nature of the violation, and any supporting information. Reports are reviewed by a person, and we act on valid reports promptly.

6. Intellectual Property

Subject to your compliance with these Terms, you retain ownership of the Generated Content you create. However, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process your uploads and Generated Content solely for the purpose of operating and improving the Service.

The Service name, logo, software, and underlying models remain the property of mewd.art or its licensors. You may not copy, distribute, or create derivative works from the Service itself.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that Generated Content will meet your expectations. You use the Service at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, mewd.art and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the preceding 12 months.

9. Account Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, if we believe you have violated these Terms or applicable law.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
